Privacy Policy for Diversity International , GURU INC. BV i.o. (“Dynamics Guru”)

The Companies (or what is referred to as “we/we”, “us” or “our”) undertake to protect the privacy of our candidates, clients and users of our website. We want to deliver a secure user experience. We would like to ensure that the information you provide to us, or that we collect through various channels (including our website, through written correspondence (including email), conversations with our consultants, or through our offices or websites worldwide) is only used for the purposes described in this policy.

Through this privacy policy, we inform you about the different types of personal data we collect from candidates, the objectives for which we use the data and the ways in which the data is used. We are also required to comply with the transparency obligation under the General Data Protection Regulation 2016/679(“GDPR”)of the European Union and the national legislation implementing the GDPR.

For the purpose of this privacy policy, Dynamics Guru is the controller of the personal data. Our contact information is listed at the bottom of this privacy policy

The information we collect

We collect your personal data, including but not limited to, your name and contact information (together with your email address) and other relevant information from your curriculum vitae (“CV”). When we receive your data and CV electronically, this may have been done by means of a direct application on one of our websites, or through a third-party job board.

During our relationship with you, we are likely to receive further personal information about you. This information may come directly from yourself, or from third parties, such as organisations to which we have provided your CV and who have communicated with you in connection with an application.

How we use your personal information

We retain, use and transmit your personal data for legitimate business purposes, including:

  1. provision of services to you;
  2. to maintain our business relationship, if you are a user of our website, a client or a candidate;
  3. to enable you to submit your CV for general applications, to apply for specific jobs, or to sign up for our job information. See the individual section on your CV below, which describes additional uses and endowments;
  4. to tailor your data to vacancies, to help us find a vacancy that is most suitable for you and to pass on your personal data to clients so that you can apply;
  5. to keep your data and to inform you about future vacancies, other than the specific position you have contacted us about;
  6. to answer your questions;
  7. for direct marketing of products and services, inform you about news and updates in the sector, events, promotions and competitions, reports and other information. Before we do this, you will have the opportunity to choose not to receive such communications. In addition, each communication includes an option to opt out of these communications;
  8. to meet our contractual obligations to our clients;
  9. to provide further services to you by sharing your personal data with other companies in our group of companies, as well as trusted third parties.
  10. to pass personal data to regulators or law enforcement agencies, if we are required or authorized to do so;
  11. our website uses a website registration service that allows mouse clicks, mouse movements, page scrolling and text entered in website forms to record. The data collected through this service is used to improve the usability of our website. The collected information is stored and used for cumulative and statistical reporting and is not shared with anyone else;
  12. In order to provide you with personalised content on our website, more relevant communication in our emails, and a tailored service from our consultants, your use and interactions with our website and emails are tracked and recorded. We use an external service provider to assist us in capturing, storing and analyzing this information, so that we can determine how we can provide you with a good recruitment experience. We ensure that no personally identifiable data is recorded in this database and that this information is not shared with any other company or subsidiary, other than the service provider we have chosen.

We may, in accordance with local regulations, process certain sensitive personal information (known as special category data in GDPR) where you include it in information you send to us, for example, if you include information about your health or religion in the CV you send to us. We may also be required to compare your data with the criminal record in the countries where it is legally required or permitted. We have processes in place to restrict the use and disclosure of such sensitive data, except where permitted or required by law.

The legal basis for the processing of your personal data

Under the GDPR, the main reasons for processing personal data of clients and candidates are as follows:

(a) Necessary for the conclusion or implementation of an agreement – in order to meet our obligations to provide a service to you, or to conclude an agreement at your request, it is necessary that we process your personal data.

(b) Necessary to comply with a legal obligation – we are subject to legal requirements that may require us to process your personal data. We may also be required by law to disclose your personal data to a supervisor or to a law enforcement agency;

(c) Necessary for the protection of legitimate interests – we, or a third party, must process your personal data to protect our legitimate interests (or those of a third party), provided that we have determined that those interests do not outweigh your rights and freedoms, including the right to protection of your personal data. Our legitimate interests include responding to requests and questions from you or a third party, optimizing our website and customer experience, providing information to you about our products and services, and ensuring that our products and services are executed in an appropriate and efficient manner.

(d) Consent – in certain circumstances, we may ask you for permission to process your personal data in a certain way.

How we share your personal data

If we need to investigate vacancies for you outside of Dynamics Guru, we will inform you that we intend to pass on your personal data to or to provide access to companies in our Group or companies worldwide so that they can use it for the above purposes.

Clients

We pass on your personal data to clients who have vacancies in which you are interested.

Trusted third parties

We share your personal data and, where necessary, your sensitive personal data with trusted third parties that we use to provide services that you or our clients have requested, for example:

  • checking employment references;
  • checking qualifications;
  • check for criminal records (in accordance with local regulations);
  • verification of information you have provided to third parties; and/or
  • psychometric or skill tests.

Supervisors and law enforcement agencies

As indicated above, we may, at the request of a regulator or law enforcement agency and such agencies, pass on certain personal data if the GDPR allows.

New business owners

If our company merges or is acquired by another company, your personal data will be shared with the new business owner and his advisors. If this happens, you will be informed.

How long we keep your information

How long we keep or store your personal data depends on the services we provide to you and for how long you need these services. Since we support candidates with often years, potentially throughout their careers, with job placements, the goal for which we keep candidate data is often of an ongoing nature. We regularly ensure that data is cleaned up and that our candidates’ data is updated to ensure that (a) the data we hold is accurate and (b) that we do not hold data for too long.

Our standard terms state that our clients retain candidate data, such as CVs, for the specific position you are applying for and that, as controllers of your data, they must let you know if they intend to retain your CV in order to inform you of potential future functions, or to retain your data for other purposes.

Your rights to information we hold about you

You have certain rights in relation to the personal data we hold about you. Details of these rights and how you can exercise them are listed below. We need proof of your identity before we can comply with your request.

Right of inspection

You have the right at all times to ask for a copy of your personal data that we have in our possession. If there is a good reason for this, and if the GDPR allows, we may refuse to comply with your request for a copy of your personal data, or certain parts of your request. If we refuse your request or any part thereof, we will inform you of our reasons for doing so.

Right of correction or supplement

If your personal data we hold is incorrect, outdated or incomplete, you have the right to have the data corrected, updated or supplemented. You can contact us about this using the Contact Information below.

Right to data erasing

In certain circumstances, you have the right to request that the personal data we hold about you be erased, for example if the information is no longer necessary for the purposes for which it was collected or processed, or if the processing of the information is based on your consent and there is no other legal basis for processing by us.

Right of objection or restriction of processing

In certain circumstances, you have the right to object to our processing of your personal data. You can do this by contacting us using the Contact Information below. This may be the case, for example, if we process your data on the basis of our legitimate interests and there are no compelling legitimate grounds for processing by us that outweigh your rights and interests. You also have the right to object to the use of your personal data for direct marketing purposes.

You may also have the right to restrict the use of your personal data by us, for example in circumstances where you have disputed the accuracy of the information and during the period in which we check the accuracy of the data.

Right to transferability of data

In certain circumstances, you have the right to obtain personal data that we hold about you in a structured, common and machine-readable form.

You can ask us to send that information to you, or send it directly to another organization.

The above law relates only to personal data which:

  • you have previously provided to us; And
  • processed by us through automated processes.

Although we will be happy to comply with such requests, we cannot guarantee technical compatibility with the systems of another organisation. We cannot respond to requests relating to other persons’ personal data without their consent.

Restrictions and exceptions apply to the majority of the above mentioned rights. If we cannot comply with a request for the exercise of rights, we will state the reasons for this.

Permission

To the extent that we process your personal data on the basis of your consent, you have the right to withdraw your consent at any time. You can do this by contacting us using the information in the Contact Information below.

Vacancy information

To sign up for e-mails with job information, you must provide your name and email address. This information is used to keep you informed of the latest vacancies in the sector you specify and to provide you with industry news and other information related to our services.

If you decide that you no longer want to receive this information, you can indicate it using the unsubscribe link included in each information email you receive.

E-mails with job information are sent by the Companies or by a company in our group of companies. When the sender is located outside of Dynamics Guru, your data will be sent to or accessible to the relevant entity so that it can send you the relevant e-mail with vacancy information.

Curriculum vitae

You can pass on your CV of your choice via our website or through one of our consultants. You can do this to either apply for a specific advertised vacancy, or to be considered by our recruitment consultants for vacancies when they arise.

Your CV is stored in our database and can be looked up by our recruitment consultants.

Your CV can also be emailed directly to other companies in our business group for review and introduction into their database so they can provide you with their services. You may refuse your permission to process your data outside dynamics Guru when filling out your registration form with us.

You can update your CV at any time by following the same procedure as for submitting a new CV. Your old CV will be automatically archived provided that the submission details remain the same (for example, you submit both CVs via the same email address or inform the relevant contact about the new submission).

Use of cookies

Like most websites, we place cookies on your computer or other device when you visit our sites. These cookies are primarily used to improve the functionality of our website and the user experience, or to help us optimize our websites, measure traffic and for other internal management purposes.

We use targeted and relevant banner advertising on a number of approved websites worldwide to present jobs and content to you that we believe will interest you. These ads are aimed at you based on your previous interactions with our website, with our emails and based on your communications with our consultants. Your interaction with our advertising can be used to measure the effectiveness of our advertising campaigns and to improve our marketing strategy in accordance with our legitimate interests. None of the advertising campaigns or tracking technology for advertising captures your personally identifiable data.

Transmission on the Internet

Since the Internet is a global environment, the use of the Internet to collect and process personal data means that data is transferred on an international basis. Unfortunately, the transmission of information over the Internet is not completely secure. While we do our best to protect your personal information, we cannot guarantee the security of your data sent to our site through third-party networks; every data transfer is done at your own risk. After we receive your information, we use strict procedures and security features to prevent unauthorized access to this information.

Changes to our privacy policy

This privacy policy may be changed by the Companies at any time. If we change our privacy policy in the future, we will notify you by email about material changes or updates to our privacy policy if you have provided us with your email address.
